This Privacy Policy explains how we use and share the information we collect through the Garcia’s Chicago website (the “Website”).
The Website is maintained by Garcia’s Chicago LLC (“We”, “Garcia’s” or the “Company”), which owns and operates the restaurant and event venue known as Garcia’s Chicago. The purpose of this Website is to provide you with information you may need to attend a show, book an event, eat a meal or just visit Garcia’s Chicago. This Website will give you the opportunity to browse our calendar, purchase tickets to upcoming concerts and other events, purchase Garcia’s Chicago branded merchandise and gift cards, subscribe to our mailing list, participate in ticket contests and obtain information about celebrating your special event at Garcia’s Chicago.
We will continue to evaluate this Policy as we update and expand our offerings, and we may make changes to it. Any such changes to the Privacy Policy will supersede and replace any previous Privacy Policy effective immediately upon posting to this page. It is your responsibility to periodically review the Privacy Policy as posted here for any changes. Your continued use of the Website after the posting of revisions to the Privacy Policy will constitute your acceptance of such changes. For the avoidance of doubt, you should discontinue using the Website if you do not agree with any changes to the Privacy Policy. If you want to join our mailing list, purchase tickets to a show, order food and beverages for consumption at the venue, participate in any of our contests or promotions, or engage in other activities on our Website, you will need to provide certain personal information to us or our ticketing partners. Payment card information is processed by our third party payment processors. If you are not interested in participating in such activities, you are still free to browse the Website; however, if you want to interact more deeply with what Garcia’s has to offer, you will need to provide us with the required information.

We also automatically collect non-personally identifiable information about the computer or devices (including mobile devices) that you use to access the Website. While this information cannot be associated with your personal identity, it may include the following data:

You understand and agree that Garcia’s is considered the “data controller” of the information it collects, including your Personal Information. We may use this information for any purpose relating to our business, subject to the prohibitions contained in this Privacy Policy. - to fulfill orders for food and beverages to be served to you at the venue;
- to analyze your use of, or interest in, our content;
- to communicate with you by email about upcoming concerts and events, private events that you may have contacted us about booking, and related products or services that we think may be of interest to you;
- to help us develop and display content and advertising tailored to your interests;
- to enforce our terms and conditions; and
- to generally manage our business.
6. DO WE SHARE ANY INFORMATION WITH OUTSIDE PARTIES?
Garcia’s may share your information about you with its affiliates, third-party partners/service providers and advertisers for the limited purposes described herein.
Garcia’s shares corporate ownership with the Bearsville Theater, Brooklyn Bowl, The Capitol Theatre, Lockn’ Farm, Relix Media Group and The Rock and Roll Playhouse. Accordingly, we may disclose your information to the companies operating these businesses to enable them to market concerts and other events they think you might be interested in. By submitting your personal information, you agree that we and our affiliates can provide you with this information. If at any point you do not want to continue to receive email messages from the Company or any of its affiliates, please follow the unsubscribe instructions in the relevant email.
We may also disclose your personal information to third party service providers we engage as contractors or agents to perform services for us, such as processing payments and managing email marketing services. We share information with these contractors only to the extent reasonably necessary for them to perform these services on our behalf, and pursuant to confidentiality obligations.
The Garcia’s Website provides you with direct access to our ticketing partner Ticketmaster so that you can purchase tickets to shows and other events. Our agreement with Ticketmaster allows us to access certain information, including name, zip code and email address, that they collect from you in connection with your ticket purchases.
Similarly, the Garcia’s Website provides you with direct access to our reservation partner Resy so that you can reserve tables on nights when we don’t have ticketed shows. Our agreement with Resy allows us to access certain information, including name, zip code and email address, that they collect from you in connection with your reservations.
We may also connect you with Toast, our hospitality service partner, to enable you to pre-order food and beverages to be served at the show. Our agreement with Toast allows us to access certain information, including name, zip code and email address, that they collect from you in connection with your order.
We may also disclose your personal information if we are legally compelled to do so. In other words, when the law requires it or when we have reason to believe that a disclosure is necessary or appropriate to address potential or actual injury or interference with the rights, property or operations of the Company or others. Finally, if we undergo a merger or acquisition, or sell or otherwise transfer substantially all the assets of the Company or its affiliates, or relating to the Company, your personal information may be transferred to our successor or assign.
Beyond this, the privacy practices of any third-parties are outside the scope of this Privacy Policy and their use or disclosure of your information (including your personal information) will be governed by their own privacy practices or policies. 7. SPECIAL NOTE REGARDING CHILDREN UNDER THE AGE OF 13
The Website is not directed to children under 13 years of age. We do not knowingly collect Personal Information from children under 13. Garcia’s is not responsible for independently verifying the age of each of its users. 8. YOUR RIGHTS AND OPTIONS
Marketing Communications
If at any point you do not want to continue to receive email messages from the Website or any of our affiliates, you may opt-out from receiving further emails by following the unsubscribe instructions provided in the relevant email. Please allow up to ten (10) business days for your opt-out request to be processed. In addition, If you have provided contact information while using the Website and later decide that you would rather not have Garcia’s or its affiliates use that information for marketing purposes in accordance with this Policy, you can also opt out by sending us an email at privacy@grciaschicago.live (including your name and email address) and “Marketing Opt-Out” in the subject line.
Your Rights Regarding Your Information

International Users
Please note that we may transfer, store and process your personal information outside the country you live in, including the United States. Contingent upon the scope of your usage activity on the website, please note that your personal information may be processed by staff and third-party service providers and partners in these countries. This may include using technologies such as Secure Sockets Layer (SSL) and may include one or more firewalls designed to block access from outside our network. Information we collect may be stored or processed on computers in any country where we do business. Although Garcia’s strives to protect your Personal Information and privacy, no security method or firewall can be guaranteed to protect information from hackers or human error, and we therefore expressly disclaim responsibility and/or liability for the loss, theft, destruction or inadvertent disclosure of your Personal Information. In the unfortunate event that your Personal Information is compromised, we may notify you by email at the last email address you have provided to us, in a reasonable time under the circumstances and as required under law. Delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system, as well as at the legitimate request of law enforcement should it be determined that such notification would impede a government investigation.
